Contract Conditions

The present General Contract Conditions govern the purchase of products through the website www.freshvana.com (hereinafter, “the Website” or “FRESHVANA”. By the acceptance of the present General Contract Conditions, the users agree that:

• They have read and understood what is presented in this document.

• They are people with the required ability to sign a contract.

• They accept all the responsibilities here stated.

• They are legally of age (18 years) to buy the goods offered in this site.

1. Description of purchase procedure

The procedure to purchase the products offered in the Website is as follows:

1. Select the product: The user who wishes to purchase a product available on the Website must click the “Buy” button. Before doing this, the user can consult a detailed description of the product. Afterwards, the user can continue with the purchase process until he/she has selected all the products he/she may wish to purchase through the website.

2. My cart/Products: Once the products have been selected, the user may click the “See my cart” button and an order summary will be displayed. If the user wishes to continue buying, just click on the “Continue buying” button. Otherwise click on “Confirm delivery details.”

3. My cart/ Delivery details: Hereafter, the user must fill in a specific form related to the shipment of the order. The user who registered his/her delivery details in a previous order will not need to fill in the form. If that is not the case, the user must include the delivery and billing details before confirming payment details. Once filled in, click on “Look up your order”.

4. My cart/ Look up your order: In order to confirm the order, the user must choose the method of payment (either credit/debit card or direct debit). On the same screen, the user can see the order summary. Before the payment is made, all the order data is displayed for the user to check it in case there is a mistake and he/she needs to go back to “My cart/Delivery details” and modify it. Once the data is verified, the user must click on “Order” and he/she will be transferred to the corresponding payment platform.

5. My cart/Order confirmation: Once the order has been confirmed, the user will be shown the confirmation of the order reception. The order will be processed once FRESHVANA has received the confirmation of payment according to the method of payment chosen in the previous step “Look up your order”. The user may continue buying once the purchase process has been completed. Once completed, the user will receive an email with all the information related to his order (order number, purchased products, delivery times and other information about shipping costs.].

2. Shipping conditions

FRESHVANA delivers its products to mainland Spain (Not to Ceuta, Melilla, Canary Islands or Balearic Islands)

Shipping costs are included in the price of all products.

FRESHVANA makes great efforts to deliver all its orders in due time. The order delivery will take place where the user chose and within the deadline set in the product details. FRESHVANA will not take responsibility when the delivery fails due to inaccuracy or falsity of the details provided or absence of the recipient.

FRESHVANA will not take responsibility when there is a delivery delay due to reasons not directly attributable to FRESHVANA, for reasons out of the company’s control or cases of force majeure.

3. Prices of products offered in FRESHVANA

The prices of the products offered on the Website include the value-added tax (VAT) and other possible applicable taxes (in any case expressed in euros (€)), unless otherwise stated.

If the user needs information about the order, he can email us at info@freshvana.com. The order number stated in the confirmation email must be indicated at all events.

4. Right of withdrawal

Users who purchase products through the Website may rescind the contract without having to justify their decision. In order to exercise this right, the user may send an email to info@freshvana.com with “Right of withdrawal” as the subject of the email and indicating the order number. The maximum period which the user has to send the email is 7 working days to count from the day the products were received.

In that case, the user must return the purchased products in perfect working order (not damaged, soiled or open by the user) with adequate protection and in its original packaging. Once FRESHVANA has checked the good state of the products, the user will be reimbursed the total amount corresponding to the returned products using the same method of payment as in the purchase.

5. 100% satisfaction guarantee

Furthermore, FRESHVANA offers the user an additional guarantee: “100% satisfaction guarantee”. If the user tries one unit of the product and his/her expectations are not met, the purchased product can be returned. In order to exercise this right, the user may send an email to info@freshvana.com with “100% satisfaction guarantee” as the subject of the email and indicating the number of the order he/she wants to return. The maximum period which the user has to send the email is 7 working days to count from the day the products were received.

In that case, the user must return the remaining units of the purchased product in perfect working order (not damaged, soiled or open by the user) with adequate protection and in its original packaging. Once FRESHVANA has checked the good state of the products, the user will be reimbursed the total amount corresponding to the returned products using the same method of payment as in the purchase. This guarantee offered by FRESHVANA does not include the shipping costs of the reimbursement, which will be paid by the user.

6. Nullity and inefficiency of the clause

If any clause in these General Conditions was declared fully or partially invalid or either ineffective, such invalidity will affect only that clause or part of it, prevailing the rest of term and conditions, and considering such clause as not included.

7. Applicable law

This General Conditions are governed by the laws of Spain. FRESHVANA and the Users agree to submit any controversy which could arise from the provision of the products and services at these General Conditions to the jurisdiction of Murcia, Spain, unless otherwise stated.
